Official Misconduct

Fraud, Deception and Corruption Offenses

The unlawful exercise of official power, or the unlawful failure to perform an official duty, by a public official acting in their official capacity, encompassing conduct including abuse of authority, unauthorized favoritism and neglect of official duty distinct from a straightforward act of bribery. Many jurisdictions codify it as a standalone offense, sometimes named misconduct in public office or abuse of functions, because it captures corrupt or self-interested official conduct that does not necessarily involve a direct payment or bribe from an outside party, closing a gap that a bribery statute alone would leave open.
