A criminal attempt occurs when a person intends to commit a crime and takes a substantial step toward completing it, but the intended offense does not occur for reasons the person did not intend. As an inchoate offense, attempt requires both the intent to commit the crime and conduct going beyond mere planning or preparation, and it is treated as distinct from related inchoate offenses such as conspiracy or solicitation. Common law originally did not punish attempts at all; that changed with the 1784 English case Rex v. Scofield, after which attempt became a recognized offense generally punished less severely than the completed crime.
