Hate Speech and Incitement Offenses

Offenses built around a specific act of public expression that attacks, threatens or incites hatred, discrimination or violence, or that denies a recognized historical atrocity, treated in this atlas as its own group because the legal treatment of speech itself, rather than of violent or fraudulent conduct, raises a distinct body of comparative constitutional and human-rights law. This group gathers hate speech targeting a protected characteristic, incitement to violence as a specific inchoate speech offense distinguished from the violent act itself, and genocide denial, the public denial or gross minimization of a recognized genocide, typically prosecuted as part of a broader hate-speech or incitement framework. It excludes seditious libel and criminal anarchy, whose target is specifically the political authority of the government rather than a protected group or class, which belong under Treason, Sedition and Offenses Against the State.
