Continuing Trespass

Property Offenses Without Violence

A continuing trespass is a wrongful act carried out through a course of conduct that directly invades another person's rights, rather than through a single completed act. One recognized form occurs when someone takes another person's goods without at first intending to keep them and only later decides to keep them for good; the law treats the original taking as continuing up to that later decision, so the later act of keeping the goods counts as larceny.
