The manufacture, sale, delivery or offering for sale of equipment, products or materials primarily intended for use in cultivating, manufacturing, concealing or consuming a controlled substance, a distinct offense from simple possession of drug paraphernalia because it targets the commercial supply chain that furnishes such equipment rather than an individual's own use. United States federal law, at 21 U.S.C. 863, makes it unlawful to sell or transport drug paraphernalia through interstate commerce or to import or export it, and most American states separately criminalize the delivery or sale of paraphernalia with knowledge or reasonable cause to know it will be used with a controlled substance, with penalties in some states reaching felony level distinct from the lesser charge typically applied to simple possession alone.
