Misbehavior before the enemy is an offense under Article 99 of the Uniform Code of Military Justice. It covers a member of the armed forces who, before or in the presence of the enemy, runs away, shamefully abandons or surrenders a command, unit, place, or military property, endangers safety through disobedience or neglect, casts away arms or ammunition, behaves with cowardice, quits a post to plunder or pillage, causes a false alarm, willfully fails to engage the enemy as duty requires, or fails to provide practicable relief to allied forces in battle. The offense may be punished by death or another punishment a court-martial directs.
