Release of a prisoner without proper authority is an offense under Article 96 of the Uniform Code of Military Justice. It covers a person subject to military law who, without authority to do so, releases a prisoner, or who through neglect or design allows a prisoner to escape, regardless of whether the prisoner was originally committed in strict compliance with the law. The same article separately punishes unlawfully drinking an alcoholic beverage with a prisoner. A person convicted under either provision is punished as a court-martial directs.
